A. Information We May Collect

We may collect two types of Information while you are using our Services:

Please note that the above-mentioned personal information is not automatically gathered or captured from our Online Platform. These will only be stored in the company’s server and database once you click the SUBMIT button.

Other Information We Collect Automatically

Device Information. We may collect certain information automatically when you use our

Online Services, such as your Internet protocol (IP) address, device and advertising identifiers, browser type, operating system, Internet service provider, the date and time of your visit, information about links inside our website, including the pages you view, the general manner in which you navigate the site, and other standard server log information in order to give our website designers an insight on how to develop a more user-friendly website UI (User Interface).

Device Location. We may also indirectly collect certain information when you use our Online Services, such as your computer’s IP address, your mobile device’s GPS signal. in order for us to provide you with more accurate information and services based on your location.

B. Use of Information

We will use your information as follows:

B.1. To contact you/ Provide Customer Service
We will use your personal information such as name and contact details, to help us provide you with better customer support, resolve any issues you may have, and improve our services.
Records of our communication may also be recorded for a short period of time (based on our retention policy) to help us review and take note of important information that we have discussed with you.

B.2. To register you in our Online Platform (Registration)
A user may need to first complete a registration form in order to use the Online Services. During registration, a user is required to give certain information (such as name and email address). This information is used to contact you about the products/services on our Site in which you have expressed interest.

You have the choice to provide us with your demographic information (such as your gender or age), but it is not mandatory.

B.3. To process your orders
We may request information from you on our Order Form for us to take note and process your orders.
B.4. To process payment
To process the payment of goods and services that you ordered/ acquired, we will need to collect your financial information such as credit card number, name on the credit card, and expiration date.
B.5. To process Billing
Your information will be used for billing purposes and to fill your orders. If we have trouble processing an order, we will use this contact information to contact you.
B.6. To process shipping
In order for us to ship your product,we will collect your complete name (first name and last name) and the shipping address.
B.7. During Surveys and contests
There will be times that our Site may request information via surveys or contests. Participation in these surveys or contests is completely voluntary, and you may choose whether or not to participate and disclose your information.
Information that we may request if you want to participate in our survey or contest may include personal details such as first name, last name, and age level together with your residence or shipping address.
This information will be used to notify the winners and send the award prizes.
As for the surveys, your information will be used for purposes of monitoring and/or improving our processes and the use and satisfaction while using our Online platform.
B.8. To provide After Sales/ Marketing services, we may also contact you via email in the future to tell you about our specials, new products/ services.

Our Online Platform/ website may use chat functionality to enable direct communication with you. We will primarily use such information to assess your needs and provide you with the necessary support and details pertaining to your queries.

B.11. To Comply with Applicable laws

B.12. For back-up/ Record keeping and regular monitoring of business activities We may use your Information to process and keep a record of your transactions with us that includes verifying your identity, processing payments and delivering products or services.

C. Data Storage

C.1. All information collected and maintained by the company is kept in US secured and with 24/7 operational data centers which are kept in a secured environment.

C.2. Secured Storage of Third-party Vendors/ Partners.
We also store all the client’s data on a password-protected cloud server provided by third-party hosting vendors with whom the company has contracted. The said contractors have established security measures to protect their personal information from unauthorized access, use, or disclosure.

C.2. Our company handles data internationally, and we always ensure compliance with frameworks such as the EU-US Privacy Shield or Binding Corporate Rules that may be necessary to facilitate lawful data transfers.

D. Disclosure to Third-Parties

D.1. Disclosures

We will only share or disclose your Information with authorizedHealthcare Providers and third parties as outlined in this Policy. For example, AlwaysPharma may share your Information with a medical provider for purposes of prescription creation or telemedicine appointment.

We may also share Information with other third-party companies that we have a business relationship with or hire to perform services on our behalf. For example, we may hire a company to help us send and manage email, and we might provide that company with your email address and certain other information in order for them to send you an email message on our behalf. Similarly, we may hire companies to host or operate some of our Services.

These providers and companies may use your Information to assist AlwaysPharma in its operations and to efficiently provide you with its Services. Contracts have been entered into with these service providers which include commitments and agreements to limit their access and use of Information as well as to comply with privacy and security standards.

D.2. Disclosures of Information to Trusted Third-Parties or for Other Purposes

We do not allow third parties that collect cookie and other internet usage data to use the said data for marketing purposes without your consent.

We may share your personal information with trusted third-party service providers, as necessary for them to perform services and facilitate transactions on our behalf, such as, but not limited to: payment processors, prescribing physicians and other health care providers, order fulfillment and shipping partners, and other service providers that perform business functions on our behalf.

We may disclose your Information if required to do so by law or in response to valid requests by government authorities such as a court or a government agency, and regulatory bodies. This includes:

D.4. Business Transfers
In the event that we are involved in a merger, acquisition, reorganization, or sale of all or a portion of our assets, your information may be transferred after we have acquired your consent. Rest assured that we will provide a notice and acknowledge your consent before your information is transferred to the new system and will be subject to a different privacy policy.

D.5. Disclosure with Your Consent or At your direction
We may disclose your Information to any third parties when we have your explicit consent to do so. You have the right to withdraw your consent at any time.

D.6. Sharing for Marketing Purposes
We may share your Information with third parties for marketing purposes only if you have provided your consent. This includes: Promotional Offers: To inform you about products, services, and offers that may be of interest to you.

Third-Party Marketing: To allow third-party partners to send you promotional materials, provided you have agreed to such sharing. Please note that if you access third-party services, such as Facebook, Google, or X (Twitter), to share information about your experience with our Online Services, these third-party services may be able to collect information about you, including information about your activity on the Sites, and they may notify your connections on the third-party services about your use of the Sites, in accordance with their own privacy policies.
If you choose to engage or share your activities in the above-mentioned public social media / websites, you should be aware that any information you share there can be read, collected, or used by other online users/ subscribers of these social media platforms. We are not responsible for the information you choose to submit in these public online platforms.

D.7. Uses and Disclosures of PHI:
Your PHI may only be used as necessary to fulfill our obligation in relation to your acquired products and services and provide you with assistance or when required by law.

E. Data Retention and Disposal.

E.1. How long would AlwaysPharma keep your Information

AlwaysPharma follows a strict data retention policy, keeping records only for as long as required for business operations, archival purposes, and/or legal requirements. We retain records for as long as you have an active account with us, or longer when required by applicable law.

Therefore, the retention period of Information is determined based on factors such as the type, amount, and sensitivity of the information; potential risks of harm from unauthorized use or disclosure; and our business needs and legal obligations.

While we take appropriate measures to protect our systems from accidental or malicious loss or destruction, residual copies of Personal Information may be temporarily retained in our backup and archival systems. However, these copies will eventually be automatically deleted or securely disposed of where deletion is not possible.

Our goal is to ensure the responsible and secure management of Personal Information in accordance with our data retention policy.

After deactivating your account, it is important to note that if you decide to utilize our Online Services again, we will ask you again to encode and submit to us your personal information.

E.2. Disposal.
After the legitimate purpose of the collected personal data has been fulfilled, all records will be permanently deleted from the system, including those stored on the company's backup storage system.

Physical records (if any) will be disposed of through shredding.

Digital files will be anonymized to ensure that personal information cannot be retrieved, processed, or accessed by unauthorized persons.

F. Data Security and Protection

At AlwaysPharma, the security of your Information is of utmost importance to us.

We understand that your Information is personal and confidential, and we are committed to ensuring that it remains secure at all times.

To this end, we have implemented strict Organizational Measures, Physical Measures, and Technical Measures to protect your Information from unauthorized access, as well as other security threats and hazards that could compromise its availability, confidentiality and integrity.

Furthermore, we continuously evaluate and validate the effectiveness of our security controls, policies, and mechanisms through annual assessments, and audits. These efforts help us to ensure that your PHI is always secure and protected with us.

Through the process provided on our site, we allow you to access certain information about you for the purpose of viewing, and in certain situations, updating that information.

The types of information that you can access and update may change as our site changes. You may also contact us as set forth in the “Contact Us” section below to request access to, or update, your personal information. You may request deletion of your account by sending a message to the “Need Help” page or by clicking this button.

G.1. Cookies and predetermined system settings.
All major browsers allow you to block or delete cookies from your system. Where we have requested your consent to use or share your personal information, you have the right to withdraw such consent, however, you may no longer be able to benefit from certain products and services.

For example, Local Shared Objects can be controlled through the instructions on Adobe’s Setting Manager page. Before processing your request, we may need to verify your identity, in which case we may request additional information from you or send you a one-time use access code to the email address or phone number associated with your account. We will use reasonable efforts to respond to your request promptly. We generally will not charge a fee for processing or responding to your request, apart from in exceptional circumstances. In those cases, we will explain the reasons and indicate the amount in question. Should we need to refuse your request, we will explain to you the reasons for this.

G.2. For California Residents.
California residents are entitled once a year, free of charge, to request and obtain certain information regarding our disclosure, if any, of certain categories of personal information to third parties for their direct marketing purposes in the preceding calendar year. Right to know / be informed.
Right to be informed means that the data subject has the right to know whether their personal data shall be, are being, or have been processed, including the existence of automated decision-making and profiling.

Right to access.
Right to access involves being able to compel any entity possessing any personal data to provide the data subject with a description of such data in its possession, as well as the purposes for which they are to be or are being processed. This must be complied with in an easy-to-access format, accompanied by a description in plain language. The data subject has the right to request information regarding the designation, name or identity, and address of the PIC’s data protection officer (DPO).

Right to object the processing of personal information
Right to object to the processing of the data subject’s personal data where such processing is based on consent or legitimate interest. They can also object to the processing of their personal data for direct marketing, profiling, or in cases of automated processing. It grants the data subject the choice of refusing to consent, as well as the choice to withdraw consent, as regards collection and processing.

Right to erasure/ blocking
Right to erasure or blocking allows the data subject to suspend, withdraw, or order the blocking, removal, or destruction of his or her personal information from the personal information controller’s filing system in both live and backup systems.

Right to rectify
Right to rectification, allows the data subject the right to dispute the inaccuracy or error in their personal data and have the PIC correct the same within a reasonable period of time.

Right to Data Portability.
Right to data portability enables the data subject to obtain and electronically move, copy, or transfer personal data for further use.

Right to file a complaint
Right to file a complaint with the National Privacy Commission if the data subject’s personal information has been misused, maliciously disclosed, or improperly disposed of or if any of their data privacy rights have been violated.

Right to Damages
Right to damages entitles the subject to be indemnified for any damages sustained due to inaccurate, incomplete, outdated, false, unlawfully obtained, or unauthorized use of the site visitor’s personal data, taking into account any violation of their right and freedoms as a data subject.

AlwaysPharma does not sell Personal Information. However, you have the right to opt-out of the use of analytics and targeting cookies by AlwaysPharma for the delivery of online advertising tailored to your interests. The Websites will seek your consent before deploying such cookies.

Please note that you may only make a request to know twice within a 12-month period.You may submit a request through sending us a message in our “Need Help” page or by clicking this button.

AlwaysPharma will not discriminate against you for exercising your rights under the CCPA. This means that AlwaysPharma will not provide different services or charge different prices to you based on your exercise of these rights.

We maintain information in the United States of America and in accordance with the laws of the United States, which may not provide the same level of protection as the laws in your jurisdiction.
